In compliance with the provisions of EU Reg. 2016/679 (European Regulation for the protection of personal data), we provide you with the necessary information regarding the processing of the personal data you have provided. This information is not to be considered valid for other websites that may be consulted through links on the websites of the owner, who is in no way responsible for third-party websites.

This information is provided pursuant to Article 13 of EU Regulation 2016/679 (European Regulation for the protection of personal data) and is also based on the provisions of Directive 2002/58/EC, as updated by Directive 2009/136/EC on Cookies, as well as the provisions of the Provision of the Data Protection Authority of 08.05.2014 on cookies.

Personal data that can be processed: “personal data” means any information relating to an identified or identifiable natural person (“data subject”); a natural person is considered identifiable if they can be identified, directly or indirectly, with particular reference to an identifier such as a name, an identification number, location data, an online identifier or one or more factors specific to their physical, physiological, genetic, mental, economic, cultural or social identity; (C26, C27, C30).

2. PURPOSE AND LEGAL BASIS OF THE PROCESSING

The personal data provided will be processed, in compliance with the conditions of lawfulness pursuant to Article 6 of EU Regulation 2016/679, for the following purposes:

– with prior consent for direct marketing activities: if the data subject fills in dedicated forms for data collection, in specific areas for direct marketing purposes: with prior consent and until such consent is withdrawn, for direct marketing activities by the Data Controller, market research, direct sales, satisfaction surveys, sending newsletters and promotional, commercial and advertising material or material relating to events and initiatives, by the Data Controller via automated means such as e-mail, fax, SMS or other types of messages, as well as by telephone calls via an operator, including automated calls, and by post and other information material. LEGAL BASIS: Consent pursuant to Article 6(1)(a): the data subject has given consent to the processing of their personal data.

3. RECIPIENTS OR CATEGORIES OF RECIPIENTS OF THE DATA

The personal data provided will be communicated to recipients who will process the data as data processors (Article 28 of EU Regulation 2016/679) and/or as natural persons acting under the authority of the Data Controller and Data Processor (Article 29 of EU Regulation 2016/679), for the purposes listed above in point 2. Specifically, the data will be communicated to: -subjects who provide services for the management of the information system used by the Company and telecommunications networks; -freelancers, firms or companies providing assistance and consultancy services; – parties providing services for the management of the information system used by the Company and telecommunications networks, including e-mail, newsletters and website management; – third parties collaborating with the Data Controller for direct marketing activities; -competent authorities for the fulfilment of legal obligations and/or provisions of public bodies, upon request. The subjects belonging to the above categories perform the function of Data Processors, or operate in total autonomy as separate Data Controllers. The list of Data Processors is constantly updated and available by writing to gosetto.privacy@gosetto.com or at the Company’s registered office.

4. DATA RETENTION PERIOD OR CRITERIA FOR DETERMINING THE PERIOD

The processing will be carried out in an automated and manual form, using methods and tools designed to ensure maximum security and confidentiality, by persons specifically appointed for this purpose.

In accordance with the provisions of Article 5(1)(e) of EU Regulation 2016/679, the personal data collected will be stored in a form that allows the identification of the data subjects for a period of time not exceeding the achievement of the purposes for which the personal data are processed. The storage of personal data provided depends on the purpose of the processing:

– receipt of newsletters or promotional communications in general via e-mail (until you object); timing determined on the basis of criteria about which the data subject can obtain information by writing to gosetto.privacy@gosetto.com at the registered office of the Data Controller.

5. NATURE OF PROVISION AND REFUSAL

Apart from what has been specified for navigation data, the user is free to provide personal data. The provision of data is optional or necessary depending on the specific purpose for which the data is processed. Failure to provide data marked with an asterisk (*) will make it impossible to obtain what has been requested or to use the services of the data controller.

6. WILL THE DATA PROVIDED BE TRANSFERRED OUTSIDE THE EUROPEAN UNION?

Personal data will not be transferred to countries outside the EU.

7. RIGHTS OF DATA SUBJECTS

You may exercise your rights as expressed in Articles 15, 16, 17, 18, 19, 20, 21, 22 of EU Regulation 2016/679 by contacting the Data Controller or the Data Processor at gosetto.privacy@gosetto.com. You have the right, at any time, to ask the Data Controller for access to your personal data, to correct or delete it, or to limit its processing. Furthermore, you have the right to object, at any time, to the processing of your data (including automated processing, e.g. profiling), as well as to the portability of your data. Without prejudice to any other administrative or judicial remedy, if you believe that the processing of your data violates the provisions of EU Regulation 2016/679, pursuant to Article 15(f) of the aforementioned EU Regulation 2016/679, you have the right to lodge a complaint with the Data Protection Authority and, with reference to Article 6(1)(a) and Article 9(2)(a), you have the right to withdraw your consent at any time. In the event of a request for data portability, the Data Controller will provide you with your personal data in a structured, commonly used and machine-readable format, without prejudice to paragraphs 3 and 4 of Article 20 of EU Regulation 2016/679.

2. FINALITÀ E BASE GIURIDICA DEL TRATTAMENTO

I dati di natura personale forniti saranno trattati, nel rispetto delle condizioni di liceità ex art. 6 del Reg. UE 2016/679, per le seguenti finalità:

– previo consenso per attività di Marketing diretto: nel caso l’interessato compili form dedicati per la raccolta dati, in aree specifiche con finalità di  Marketing diretto: previo consenso e fino a sua opposizione per attività di marketing diretto del Titolare, ricerche di mercato, vendita diretta, rilevazioni del grado di soddisfazione, invio di newsletter e materiale promozionale, commerciali e pubblicitario o inerente eventi ed iniziative, da parte del Titolare tramite mezzi automatizzati di posta elettronica, telefax, messaggi del tipo SMS o di altro tipo, nonché mediante telefonate tramite operatore, anche automatizzate e della posta cartacea e altro materiale informativo. BASE GIURIDICA: Consenso art. 6 par. 1 lett. a): l’interessato ha espresso il consenso al trattamento dei propri dati personali.

3. DESTINATARI O CATEGORIE DI DESTINATARI DEI DATI
I dati di natura personale forniti saranno comunicati a destinatari, che tratteranno i dati in qualità di responsabili (art. 28 del Reg. UE 2016/679) e/o in qualità di persone fisiche che agiscono sotto l’autorità del Titolare e del Responsabile (art. 29 del Reg. UE 2016/679), per le finalità sopra elencate al punto 2. Precisamente, i dati saranno comunicati a: -soggetti che forniscono servizi per la gestione del sistema informativo usato dall’Azienda e delle reti di telecomunicazioni; -liberi professionisti, studi o società nell’ambito di rapporti di assistenza e consulenza; – soggetti che forniscono servizi per la gestione del sistema informativo usato dall’Azienda e delle reti di telecomunicazioni, ivi compresa la posta elettronica, newsletter e gestione siti internet; – terzi che collaborano con il Titolare del trattamento per attività di marketing diretto; -autorità competenti per adempimenti di obblighi di leggi e/o di disposizioni di organi pubblici, su richiesta. I soggetti appartenenti alle categorie suddette svolgono la funzione di Responsabile del trattamento dei dati, oppure operano in totale autonomia come distinti Titolari del trattamento. L’elenco dei Responsabili del trattamento è costantemente aggiornato e disponibile scrivendo a gosetto.privacy@gosetto.com o presso la sede legale dell’Azienda.

4.PERIODO DI CONSERVAZIONE DEI DATI O CRITERI PER DETERMINARE IL PERIODO
Il trattamento sarà svolto in forma automatizzata e manuale, con modalità e strumenti volti a garantire la massima sicurezza e riservatezza, ad opera di soggetti di ciò appositamente incaricati.
Nel rispetto di quanto previsto dall’art. 5 comma 1 lett. e) del Reg. UE 2016/679 i dati personali raccolti verranno conservati in una forma che consenta l’identificazione degli interessati per un arco di tempo non superiore al conseguimento delle finalità per le quali i dati personali sono trattati. La conservazione dei dati di natura personale forniti dipende dalla finalità del trattamento:
– ricezione newsletter o comunicazioni promozionali in genere via e-mail (fino a sua opposizione); tempistica determinata sulla base di criteri di cui l’interessato può avere informazioni scrivendo a gosetto.privacy@gosetto.com presso la sede legale del Titolare.

5. NATURA DEL CONFERIMENTO E RIFIUTO

A parte quanto specificato per i dati di navigazione, l’utente è libero di fornire i dati personali. Il conferimento dei dati è facoltativo o necessario a seconda della specifica finalità per la quale il dato viene trattato. Il mancato conferimento dei dati contrassegnati con il simbolo*, comporterà l’impossibilità di ottenere quanto richiesto o di usufruire dei servizi del titolare del trattamento.

6. I DATI FORNITI SARANNO TRASFERITI FUORI DALL’UNIONE EUROPEA?

I dati personali non saranno trasferiti in Paesi Extra UE.

7. DIRITTI DEGLI INTERESSATI

Lei potrà far valere i propri diritti come espressi dagli artt. 15, 16, 17, 18, 19, 20, 21, 22 del Regolamento UE 2016/679, rivolgendosi al Titolare, oppure al Responsabile del trattamento, rivolgendosi all’indirizzo gosetto.privacy@gosetto.com Lei ha il diritto, in qualunque momento, di chiedere al Titolare del trattamento l’accesso ai Suoi dati personali, la rettifica, la cancellazione degli stessi, la limitazione del trattamento. Inoltre, ha il diritto di opporsi, in qualsiasi momento, al trattamento dei suoi dati (compresi i trattamenti automatizzati, es. la profilazione), nonché alla portabilità dei suoi dati.  Fatto salvo ogni altro ricorso amministrativo e giurisdizionale, se ritiene che il trattamento dei dati che la riguardano, violi quanto previsto dal Reg. UE 2016/679, ai sensi dell’art. 15 lettera f) del succitato Reg. UE 2016/679, Lei ha il diritto di proporre reclamo al Garante per la protezione dei dati personali e, con riferimento all’art. 6 paragrafo 1, lettera a) e art. 9, paragrafo 2, lettera a), ha il diritto di revocare in qualsiasi momento il consenso prestato. Nel caso di richiesta di portabilità del dato il Titolare del trattamento Le fornirà in un formato strutturato, di uso comune e leggibile, da dispositivo automatico, i dati personali che la riguardano, fatto salvo i commi 3 e 4 dell’art. 20 del Reg. UE 2016/679.
